In Indiana, if a person has a history of substance abuse and criminal behavior, penalties for certain crimes can become more severe. The Recovery While Incarcerated (RWI) program is an option for defendants facing criminal charges and struggling with addiction.

The program offers a comprehensive addiction treatment program while serving a criminal sentence, strikes a balance between treatment and punishment, and may lead to a sentencing modification upon successful completion. Eligible candidates for the program include:

  • people whose criminality appears related to their addiction,
  • people who have committed and/or served time for numerous charges related to their addiction, and
  • people who have unsuccessfully been through other substance abuse treatment programs.

The program can take up to a year to complete and is competency-based, not time-based. If you’re facing addiction issues and criminal charges, it’s best to speak to an attorney familiar with the RWI program.
