In Indiana, the legal penalties for driving while intoxicated are specified in Indiana Code § 9-30-5. This chapter covers various situations related to driving under the influence. The initial charge for a DUI is a Class C misdemeanor, as stated in Indiana Code § 9-30-5-1, which reads:

(a) A person who operates a vehicle with an alcohol concentration of at least 0.08 grams but less than 0.15 grams per:

     (1) 100 milliliters of blood, or
     (2) 210 liters of breath,

commits a Class C misdemeanor.

However, if the alcohol concentration is 0.15 grams or more, it is classified as a Class A misdemeanor.
