If you’re suspected of drunk driving in Indiana and are asked to take a chemical test, it is important to comply as refusing the test will result in an automatic one-year license suspension. The test results, which determine the alcohol concentration equivalent (ACE) or blood alcohol content (BAC), will determine the charges against you. If the ACE is less than .08, no charges may be filed.

If the ACE is between .08 and .15, it’s considered a Class C misdemeanor and carries a maximum penalty of 60 days in jail and a $500 fine. If the ACE is .15 or above, it’s considered a Class A misdemeanor with a maximum penalty of 365 days in jail and a $5000 fine.
