The legal limit for ACE in Indiana is .08, but penalties increase if it reaches .15 or more. Failing a chemical test with an ACE between .08 and .15 can result in a Class C misdemeanor, while a level of .15 or greater leads to a Class A misdemeanor with harsher penalties, including up to 365 days in jail and a $5,000 fine. Refusing a chemical test results in an automatic one-year license suspension.
